Pharmaceuticals & Tooth Whitening: Legal Restrictions
Dental Sky are a licenced distributor of various pharmaceutical and whitening products some of which have strict regulations and/or legal restrictions on their supply.
We take these responsibilities very seriously and our team manually check all orders for these items to ensure that they aren't being sent to members of the public in breach of the law and our licences.
Pharmaceutical Supply:
Under the terms of our pharmaceutical licence Dental Sky can only supply licenced pharmaceuticals to registered dental or medical professionals.
- Professional registration numbers (General Dental Council (GDC) or General Medical Council (GMC)) are required and will be checked before any licenced pharmaceutical goods are dispatched.
- In addition to this we can only dispatch licenced pharmaceutical goods to addresses registered with the Care Quality Commission (CQC) and the shipping addresses will be manually checked against the CQC database.
- Some pharmaceutical ranges are permitted to be shipped to other types of registered healthcare professionals, Veterinary or Podiatry professionals for example, although slightly different rules apply - If you are seeking supply on this basis then please contact us before placing your order so we can advise you further.
If licenced pharmaceuticals are ordered without a valid professional registration number being provided (GMC or GDC number) or if the shipping address is not registered with the CQC then your order will be cancelled and refunded - Refunds will be raised instantly but customers' banks may vary in the time they take to process the refund.
For your peace of mind, and to assist you in your regulatory compliance, all orders for licenced pharmaceuticals that are placed with Dental Sky will be fulfilled by Movianto, a GDP compliant, MHRA accredited, ISO 13485 certificated, specialist pharmaceutical logistics carrier using their dedicated temperature controlled delivery service.
Tooth Whitening Products Supply:
It is illegal for anyone other than a registered dentist to make tooth whitening products containing more than 0.1% hydrogen peroxide available to consumers.
- A valid professional registration number (General Dental Council (GDC)) is required in order for us to dispatch these products and credentials will be checked before any tooth whitening goods containing more than 0.1% hydrogen peroxide are shipped.
- Registered Dental Professionals with a GDC number, but who are not dentists, will still need to provide some further evidence that the whitening products are being ordered for use under the supervision of a registered dentist - If you're unsure whether this is applicable to you then please contact us before placing your order so we can advise you further.

FAQs
1) I can buy these pharmaceutical products elsewhere without restriction, why can't I buy them here?
Some physical stores or webshops will have a different pharmacy licence enabling them to sell things like medicated mouthwashes or toothpastes to the public. Dental Sky is not an online pharmacy and so our licence is only for the supply of pharmaceuticals to certain registered healthcare professionals.
2) I can buy these whitening products elsewhere without restriction, why can't I buy them here?
If anyone other than a registered dentist is supplying consumers with whitening products containing more than 0.1% hydrogen peroxide then they are breaking UK law.
3) I'm a healthcare professional but am unsure if the rules apply to my situation?

4) I can buy pharmaceutical products elsewhere without the need for an MHRA accredited temperature controlled carrier, why can't pharmaceuticals be sent with DPD or Royal Mail?
The Medicines & Healthcare Products Regulatory Agency (MHRA) Rules and Guidance for Pharmaceutical Distributors 2022 clearly states,
"It is expected that the supplying wholesaler can show that the required temperature ranges have been maintained. The implementation of temperature monitoring for all refrigerated deliveries is considered best practice. Temperatures should be strictly controlled and monitored with calibrated equipment of a suitable sensitivity, to provide temperature data for the entire journey."
The MHRA rules and guidance then goes on to state,
"During transport, a dedicated temperature-controlled fleet should be utilised or the services of a specialist third-party logistics provider may be contracted. As with uncontrolled ambient transport, it is unlikely that a "general courier service" will be able to provide a GDP-compliant service. GDP guidelines state that, where possible, dedicated vehicles should be used to transport medicinal products; this cannot be achieved by utilising a general courier service."
Therefore if you are receiving licenced pharmaceuticals through a general courier service then according to the MHRA it is highly unlikely that they have been delivered to you in compliance with MHRA regulations. This may mean that your own regulatory compliance could be adversely impacted as a result.
Can all your suppliers of licenced pharmaceuticals give you temperature reports specific to your deliveries of pharmaceutical items? If not, and some of them only have baseline seasonal route qualification data available for you, then this may be a sign that your pharmaceuticals are not being delivered to you in a manner that satisfies regulatory requirements.
